• "Services" includes job listing services, candidate profile hosting, job application management, AI-based matching, and other related career services.

By accepting these Terms, you represent and warrant that:

• You possess full legal capacity and authority to enter into this agreement;
• You are at least 18 years of age;
• You are a resident of India (or authorized to use the service in your jurisdiction);
• You have not been previously suspended or disqualified from using our Services;
• You will not impersonate any person or entity.

If you are acting on behalf of an organization, you confirm that you have the necessary authorization to bind that entity to these Terms.

3.1. We provide a platform for recruiters to post jobs and for job seekers to view and apply for such opportunities. We act as a facilitator and do not guarantee successful hiring or job placement.

3.2. You agree that all information provided — including resumes, qualifications, and job descriptions — is accurate, current, and not misleading. We reserve the right to suspend accounts providing false or fraudulent information.

3.3. AI-Powered Features: You acknowledge that our platform may utilize AI-based models for job matching and preliminary screening. Job Hiring Point is not liable for any outcomes or decisions made through these AI processes.

3.4. Third-Party Services: The Platform may contain links to third party services. Your use of such services is at your own risk and subject to the terms of those specific third parties.

You authorize Job Hiring Point and its affiliates to contact you via SMS, WhatsApp, email, push notifications, and AI-driven calls regarding your account, job applications, and marketing communications. You acknowledge that this consent overrides any "Do Not Disturb" (DND) registration on your mobile number.

5.1. To access Services, you must create an account. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

5.2. You agree to notify us immediately of any unauthorized use. Job Hiring Point is not liable for any loss arising from your failure to protect your account.

All rights, title, and interest in the Platform, including software, text, graphics, logos, and trademarks, are owned by Job Hiring Point. You are granted a limited, non-exclusive, non-transferable license to use the Platform. You may not copy, modify, distribute, or create derivative works from our content without our prior written consent.

You agree not to:

• Infringe upon the intellectual property rights of any party;
• Use automated tools (bots, spiders, scrapers) to collect data from the Platform;
• Transmit viruses, malware, or harmful code;
• Upload content that is obscene, defamatory, harmful to children, or violates the security and sovereignty of India;
• Reverse engineer or disassemble any part of the Platform.

8.1. The Platform and Services are provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties, express or implied, including fitness for a particular purpose or non-infringement.

8.2. Job Hiring Point shall not be liable for any indirect, incidental, or consequential damages.

You agree to indemnify and hold harmless Job Hiring Point, its team, and employees from any claims, losses, or expenses (including legal fees) arising from your breach of these Terms, your misuse of the Platform, or your violation of any Applicable Law.

We reserve the right to terminate or suspend your access to the Platform immediately if you breach these Terms. Upon termination, your right to use the Services shall cease, and you must discontinue all use of the Platform.

11.1. These Terms are governed by the laws of India.

11.2. Any dispute shall be resolved through binding arbitration in Noida, in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Noida.

11.3. The cost of arbitration shall be determined by the arbitrator. Each party shall initially bear their own costs, subject to the final award.
